- 1.0 General
1.1 These conditions of use apply to all services offered on the internet page http://www.E7.to via the internet service http://E7.to - subsequently called E7.to. The use of these services denotes acknowledgement of these conditions of use.
1.2 Any differing conditions of the user shall have no validity.
2.0 Contents
2.1 Only those pages offering contents without any age restriction shall be permitted.
The user promises to observe the services with the necessary care so as to avoid
the incurrence of any improper additional costs. Spamming and “Warez“ shall not
be tolerated in any form.
2.2 The user promises not to offer or have offered any pornographic contents or
services oriented towards the making of profit with a pornographic or erotic
content. In addition, the user promises not to offer radical right- or left-wing
contents, or contents glorifying violence.
2.3 Any breach of these conditions shall entitle E7.to to exclude the user
immediately from the service without notification.
3.0 Services
3.1 E7.to shall endeavour to maintain the availability of the service around the clock. The exception here is the times during which the web server is not accessible via internet owing to technical or other problems beyond the power of E7.to (e.g. force majeure, third-party negligence). No-one has a claim to the constant availability of the service. All services, as well as any support, are provided on a purely voluntary basis. There is no legal entitlement to these.
3.2 For the provision of the service, E7.to is entitled to overlay an advertising window or frame when redirecting. This can include one’s own advertising as well as that of third parties. Exclusions do not have to be justified and can be effected without previous notification.
4.0 The rights of third parties
4.1 The user expressly assures that the provision and publication of the contents of the
information selected are neither an infringement of German law nor any other right of domicile ensuing from this law, in particular copyright, data protection rights and trading rights. E7.to reserves the right to exclude offers from the service which look dubious, without giving any previous notification. The same applies if E7.to is requested by a third party to change or delete contents on the web pages because they apparently violate third-party rights.
E7.to is not required to carry out a statutory inspection.
4.2 The user promises to exempt E7.to from all possible third-party claims arising from any illegal action by the user or errors in the content of the information the latter has provided. This particularly applies to copyright, data protection and trading right violations.
5.0 Data protection
5.1 The user shall always provide E7.to with genuine information.
This particularly applies when requesting personal data. The user grants E7.to the right to publish the name and email address of a "Who is" request.
5.2 The user promises to keep his access identification characters and passwords secret, so as to prevent any third parties from gaining access to the system. The user consents to E7.to saving any personal data or other information concerning his usage behaviour, insofar as this serves the purpose of the service. This does not apply if E7.to is legally bound to disclosing such data to third parties, especially state authorities, but does so if internationally recognized technical standards provide for this and the user does not oppose.
6.0 Limitation of liability
6.1 The user alone is responsible for the contents of the pages. Furthermore, the user agrees that the use of the services are effected at his own risk. The user is liable for any use of the service effected via his user identification character. In the case of minors, the parents or legal guardians are responsible for complying with the contractual agreeement.
6.2 These conditions also apply to third party contents. The services are provided by E7.to without any guarantee, as they are currently available. E7.to is not liable at all for any damages of any type.
7.0 Final provisions
7.1 Amendments and additions to these conditions shall be announced in the written form and are considered as accepted and binding if the user does not revoke these changes within two weeks. All explanations on the part of E7.to can be addressed to the user electronically. Any explanations from the user to E7.to require the written form. This does not apply to support enquiries or the like.
7.2 If individual provisions in these conditions are or become completely or partially invalid, this does not affect the validity of the remaining provisions. In such a case, an ineffective provision shall be considered as replaced by an effective provision if it corresponds as closely as possible to the purpose pursued with the ineffective provision. The same applies if these conditions of use should show any loopholes.
